Legal Templates & Model Agreements

The General Secretariat publishes the following legal templates and model agreements to assist States, intergovernmental organizations, and other entities in their dealings with the International Organization for Identity Documents.

All templates are informational. The authoritative obligations of Contracting Parties derive from the Charter and the instruments adopted thereunder, not from the model texts.


Model Instrument of Ratification

For use by a State that has signed the Charter and has completed its domestic constitutional or legal procedures for approval.


INSTRUMENT OF RATIFICATION

The [Head of State / Head of Government / Minister for Foreign Affairs] of [Name of State],

Having considered the Charter of the International Organization for Identity Documents, done at ____________ on the _______ day of ____________, _______,

In accordance with the constitutional requirements of [Name of State],

Model Instrument of Accession

For use by a State that has not signed the Charter and wishes to accede to it at any time, in accordance with Article 9 of the Charter.

Guide to Ratification and Accession

The General Secretariat has published a comprehensive guide to the ratification and accession process, covering, inter alia:

  • Practical steps from expression of interest through deposit of the instrument;
  • Domestic procedures and preparation of instruments;
  • Deposit procedures and acknowledgment;
  • Obligations upon becoming a Contracting Party;
  • Assessed contributions;
  • Observer status as an alternative for States not yet ready to accede.

Model Headquarters Agreement

A model headquarters agreement for use between the Organization and a State hosting the seat or a regional or field office of the Organization is under preparation by the General Secretariat. It will be published in this section upon completion.


Standard Contract Clauses

Standard clauses for use in contracts between the Organization and contractors, consultants, and suppliers, including, inter alia, intellectual property assignment provisions, confidentiality obligations, and dispute resolution clauses referring disputes to the Internal Court of Arbitration, are under preparation by the General Secretariat and will be published in this section upon completion.


Deposit of Instruments

Instruments of ratification and accession shall be deposited with the Office of Legal Affairs, which serves as the Depositary for the Charter.

Deposit may be effected, inter alia, by delivery in person by the Permanent Representative or other authorized representative, by transmission through diplomatic channels, or by such other means as may be agreed with the Depositary.

Upon deposit, the Depositary will acknowledge receipt, notify all existing Contracting Parties, and communicate the date of deposit to the new Contracting Party. Membership takes effect on the date of deposit.
